A federal judge Monday afternoon ordered Tennessee to stop enforcing new rules that restricted “Occupy Nashville” demonstrators’ ability to protest in response to a lawsuit filed by the American Civil Liberties Union of Tennessee (ACLU-TN).

“The state cannot arbitrarily create restrictive policies just because it does not like how people are using a public space,” said ACLU-TN Legal Director Tricia Herzfeld. “Today’s decision is the first step in restoring demonstrators’ free speech rights.”

The protesters had been camped at Legislative Plaza in downtown Nashville to protest the economic and political consolidation of power since October 9.

“We hope the fact that the State did not contest the temporary restraining order means that it is recommitting itself to safeguarding — not thwarting — public political expression,” said Hedy Weinberg, ACLU-TN Executive Director.

This is an excellent piece of news! You have to hand it to OWS - they aren't letting intimidation tactics or attempted hijacking of their purpose stop them. They are staying on message and staying strong. Way to go, OWS!

If y'all think this will stop the pigs from beating on people y'all best think again. At the same time this ruling also gives people the right to defend themselves and fight back. Even against those who supposedly uphold and have interest in law and order. Namely those damn pigs who's own rights are in jeopardy yet they still side with those who would take their collective bargaining rights away. Now what kind of sense does that make? If the pigs keep this up We The People ought to separate the pigs along with federal politicians from firemen and teachers and let the political pigs chance it on their own. Corporate America thinks they have everyone they need in their pockets. Occupy needs to keep going at least through the 2012 election cycle to weed out the financial crooks and fools who are still taking down the economy. Namely Republicans.

Just like the night judge that refused for 3-4 nightsto sign off on arrest warrants which meant all the protesters had to go free. The attempted corporate police state is running into some trouble with the legal system who would of though it.

An inspiring seed. It is sad that it took a judge to stop the attempts to stifle the American people. However, this is one excellent step into using our power as the people of our country to produce change. It works. The power of millions of people standing together cannot be stopped.

It is indeed sad when we have to go to court to ensure the rights given to us by the Constitution are truly ours.

I am not for or against the Occupiers, mostly because I am still unclear with what they want.

I saw a college student with a sign who wanted his student loans paid off for him on The Colbert Report, coulda been Jon Stewart, when asked why, the student didn't have a good reason, "its something I want" I believe was his response.

So can anyone explain it please?

That is some good news, but it just goes to show that the freedoms we expect and call our rights don't come easy or freely. Never forget.

Fernando - does it really matter what they want? Just start with the fact that they wanted to assemble.

Yes it does really matter. I 100% support their right to assemble, just like I would support the right of any group to assemble even the ones I think are douchebags (KKK, Nazi's, the group that pickets service members funerals, I dont like to mention their names, whomever). When there is no clear direction, who do we follow, and when there is no clear leadership, who do we hold accountable?

fernando, I'm surprised that anyone still doesn't understand what the protesters are trying to do.

They are trying to force awareness of a situation that is turning our nation into a poverty state, which the media largely chooses to ignore. They're trying to put an end to the apathy of the average American who doesn't understand how the 99% is being exploited for the benefit of the 1%, and that as long as politicians cater to the wealthy, the exploitation will continue unabated.

They are trying to make people understand that the growing wealth disparity is NOT an indication of a healthy economic future, and that while no one may have a solution right now, it's time to start thinking about a solution because history has shown what happens to countries where the vast majority of the wealth becomes concentrated in very few hands.

I say good for them for trying to initiate much-needed change, and I challenge anyone to prove they are all nothing more than lazy, liberal free-loaders looking for handouts.

How dare we protest corporations that make billions in profit, yet lay off thousands of people, just so executives can give them selves big fat bonuses. How dare we protest them spending hundreds of millions of dollars lobbying our government. Instead we should be on the ground washing their balls and kissing their feet because they are so important (and don't want to get laid off).

If anyone can't figure out that was sarcastic then they are friggen brain dead.

Company I work for is smaller, everyone took a raise freeze, gave up our profit sharing for a year, slashed our training budgets, slashed our technology budgets, because the company wasn't doing well with sales. However the executives all got their nice 20,000.00 bonus checks.

No really just kidding, but let me explain what Silvaria means by wealth disparity is that there is a large group of people who are sitting on their duff and not doing anything to create their own wealth, and since Obama and company just keep handing it out it goes to those who want wealth, there fore income desparity happens. It is not that they cant have wealth it's just that they bought into the leftist view that they werent allowed to have wealth and the right wont let them.

As I requested in my previous post but you ignored, prove that everyone who is alarmed and disgusted by the ever-growing wealth disparity are just people who are looking for something for nothing.

And next time, an actual link may help.

Nice. A judge who understands the right to gather and petition the government. There's been a creeping and constant use of ordinances and restrictions (protest "zones" for instance) over the last decade that has been eroding one of our most basic rights. Hopefully this is used in other cities as basis to win back similar freedom through the courts if necessary.

It is a great win for all but for at least 99% of us, it is fantastic news. For the other 1% and those deluded enough that they think they will be there soon if they follow the r/tp mantra, it may not sound like such good news. If they open their eyes though, they may actually see that it will help them eventually, at least to the degree of keeping other liberties free from government mandate.

Regardless, this IS good news for us and for the constitution.

Whoa--freedom of speech in America? That's a radical concept. The next thing you know, they will talk about restoring the Fairness In Media doctrine and wrest control of the airwaves from corporate spokespersons and talking heads--nah, that's never gonna happen.

Because in the U.S., the Supreme Court protects only the speech rights of the moneyed interests.

The Constitution, being a document of federal laws,

No the Constitution is not a document of laws....

It is a Document of restrictions on government powers... Its not about Laws...Its about restraint of government and explaining its limitations...and its responsibilities...

Its not Laws...Its the foundation of our Laws..

Which part of The 10th Amendment do you not agree with...

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people

Show me in the Constitution where this was specified as a power given to the Federal Government?

I'll wait... For you to provide where the Federal Government was Constitutionally given the ability to have total control over local permitting for rallies and protests...
